These Terms and Conditions govern your access to dispensarydomination.com and your purchase or use of products and services from Dispensary Domination LLC.

By using the website, creating an account, placing an order, submitting an intake form, or using a product or service, you agree to these Terms and Conditions and the policies linked within them.

If you use the website or purchase services for a business, you confirm that you have authority to accept these terms for that business. “Customer,” “you,” and “your” refer to both you and the business you represent.

About Dispensary Domination

Dispensary Domination LLC is a California company that provides marketing services, research, training, digital products, and the Dispensary Domination System to dispensaries and related businesses.

Our products and services may include local visibility work, website improvements, content, research, business listings, Google Business Profile work, analytics, conversion work, reputation support, advertising support, email marketing, reporting, training, and related services.

Business Use and Authority

Our products and services are intended primarily for businesses and adults acting in a professional capacity.

You confirm that:

  • You are at least 18 years old
  • You may legally enter into a binding agreement
  • You are authorized to act for the business identified in the order
  • The information you provide is accurate
  • Your purchase and intended use are lawful

An internal dispute between owners, employees, managers, investors, agencies, or other representatives does not invalidate an otherwise authorized purchase.

Accounts

You may need an account to purchase products, access downloads, manage subscriptions, save wishlists, or use other website features.

You are responsible for:

  • Providing accurate account information
  • Keeping login information secure
  • Limiting access to authorized users
  • Updating contact and billing information
  • Notifying us promptly of suspected unauthorized access
  • Activity performed through your account

We may suspend or restrict an account when we reasonably believe it is being misused, compromised, used unlawfully, or connected to fraud or a payment dispute.

Product and Service Information

We aim to describe each product and service accurately. Product pages may identify the scope, quantity, deliverables, customer responsibilities, options, exclusions, estimated timing, and price.

The product page, accepted proposal, order confirmation, statement of work, and these Terms and Conditions together form the agreement for the purchase.

Images, examples, reports, case studies, and sample deliverables are provided to explain the type of work offered. They do not promise an identical format, strategy, result, or outcome for every customer.

Orders

Submitting an order is an offer to purchase the selected product or service. We may accept, reject, or request more information about an order.

We may cancel an order and return the amount paid if:

  • The order contains a clear pricing or technical error
  • We cannot provide the purchased service
  • The requested work creates a legal, ethical, safety, or platform risk
  • The customer is outside the service’s stated eligibility or scope
  • We suspect fraud or unauthorized payment
  • A conflict of interest prevents us from accepting the work

An automated order confirmation does not require us to perform work that falls outside the purchased scope or violates these terms.

Prices, Taxes, and Fees

Prices are shown in United States dollars unless stated otherwise.

You are responsible for applicable taxes, duties, currency conversion charges, bank fees, and other charges imposed by a government, payment provider, or financial institution.

We may change prices for future purchases. A price change will not alter a completed one time purchase.

Payment

Payment is due according to the checkout page, invoice, proposal, or written agreement.

Payments may be processed through WooPayments, Stripe, PayPal, or another disclosed payment provider. Your use of a payment provider is also subject to that provider’s terms and privacy policy.

You authorize us and our payment providers to charge the selected payment method for:

  • The purchase price
  • Applicable taxes
  • Approved additions or changes
  • Recurring charges you authorized
  • Amounts otherwise due under the order

You must provide valid and current payment information. Failed or disputed payments may delay or suspend work, access, downloads, accounts, or recurring services.

Recurring Billing

The Dispensary Domination System is a recurring month to month service.

By purchasing a recurring service, you authorize Dispensary Domination and its payment provider to charge the payment method on file at each billing interval until the service is canceled.

The checkout page or order confirmation will disclose the recurring price and billing frequency. We will provide notice of material price changes where required.

If a recurring payment fails, we may retry the payment, request another payment method, pause work, suspend access, or end the service.

Canceling the Dispensary Domination System

The Dispensary Domination System requires 30 calendar days’ written cancellation notice.

Send cancellation notices to support@dispensarydomination.com. If account based online cancellation becomes available, you may also use that method.

The notice must identify the dispensary, the person authorized to cancel, and the service being canceled. We will not require a telephone call when a valid written cancellation request has been received.

Cancellation becomes effective at the end of the applicable billing period after the full 30 day notice requirement has been satisfied.

If a billing date occurs before the 30 day notice period ends, another recurring payment may be charged. Service will continue through the paid billing period. Partial and prorated refunds are not provided.

We may perform extra setup, planning, research, or production work early in the relationship to give the campaign a stronger start. Work completed during one billing period may support future periods. The amount of work visible during one month does not determine whether that month’s payment is refundable.

Refunds and Returns

Custom services, completed work, digital products, downloads, and monthly payments are generally nonrefundable.

Our Refund and Returns Policy explains final sale terms, error reporting, duplicate charges, digital products, monthly services, and the limited situations in which a correction or refund may be available.

Intake Forms and Customer Cooperation

Many services begin only after we receive the completed intake form, required information, and necessary account access.

You agree to provide accurate and reasonably complete information, materials, approvals, and access needed to perform the work.

You are responsible for delays, errors, incomplete work, or reduced results caused by:

  • Missing or inaccurate information
  • Delayed responses or approvals
  • Missing, expired, or revoked account access
  • Internal disagreements
  • Changes made by you or another provider
  • Failure to follow reasonable instructions
  • Platform restrictions affecting your accounts

A customer delay does not cancel an order, create a refund right, or require us to hold scheduled production time indefinitely.

Project Timing

Any delivery date or timeline is an estimate unless a written agreement clearly states that it is guaranteed.

Timing may depend on customer cooperation, project scope, platform access, approvals, revisions, third party systems, workload, and unexpected technical conditions.

We may adjust schedules when information or access arrives late, the scope changes, a third party causes delay, or circumstances outside our reasonable control prevent timely work.

Scope and Additional Work

Your purchase includes only the work stated on the product page, order, proposal, or written agreement.

Requests outside that scope may require:

  • A separate purchase
  • An added fee
  • A revised timeline
  • A written change to the project

We are not required to perform additional work merely because it relates to the same website, account, campaign, or business goal.

Revisions and Approvals

Revisions are included only when stated on the product page, proposal, or written agreement.

A revision changes work within the approved scope. It does not include a new direction, new subject, added page, added market, added product, added platform, or other expansion of the purchase.

You are responsible for reviewing deliverables before approving or publishing them. Approval may be given through email, a project system, a form, a meeting, or another reasonable method.

We may treat a deliverable as accepted if you do not report a material error within the period stated in the Refund and Returns Policy.

Third Party Platforms

Our work may involve Google, Bing, WordPress, WooCommerce, social networks, directories, review platforms, advertising systems, analytics services, email platforms, menu providers, hosting companies, and other independent services.

We do not control whether a third party:

  • Approves or rejects an account, listing, advertisement, or submission
  • Changes its rules, algorithm, prices, or features
  • Suspends or removes content
  • Experiences downtime or data loss
  • Limits cannabis related businesses
  • Changes access or verification requirements
  • Stops offering a product or service

A third party’s action or failure does not mean Dispensary Domination failed to provide the purchased service when we completed our agreed work.

You are responsible for third party subscriptions, licenses, advertising costs, hosting, renewals, and platform charges unless the written scope states that a specific cost is included.

No Guaranteed Results

Marketing results are not guaranteed.

We do not guarantee:

  • Search rankings
  • Google Maps placement
  • Website traffic
  • Calls, visits, orders, or sales
  • Revenue or return on investment
  • Customer reviews
  • Advertising approval
  • Platform approval
  • Media coverage
  • Link placement
  • Directory acceptance
  • Regulatory approval

Results may be affected by competition, location, website condition, customer participation, inventory, pricing, reviews, market demand, platform rules, search engine changes, laws, advertising limits, and other conditions outside our control.

Past results, projections, opportunities, estimates, and case studies do not guarantee future performance.

Cannabis Laws and Compliance

Dispensary Domination provides marketing services. We do not provide legal, tax, licensing, medical, or regulatory advice.

You are responsible for confirming that your business, products, promotions, claims, content, advertising, sweepstakes, customer communications, and requested work comply with all applicable laws and license requirements.

We may refuse, pause, remove, or revise work that we reasonably believe creates a legal, regulatory, platform, safety, or reputational risk.

Customer Materials

You retain ownership of materials you provide, including names, logos, photographs, videos, product information, business information, and existing content.

You give Dispensary Domination a nonexclusive license to access, copy, modify, format, publish, transmit, and use those materials as reasonably needed to provide the purchased services.

You confirm that:

  • You own the materials or have permission to use them
  • You may authorize us to use and modify them
  • The materials do not violate another person’s rights
  • The information and claims are accurate
  • The requested use is lawful

Ownership of Final Deliverables

After full payment, the customer owns the final custom deliverables created specifically for that customer, subject to the exclusions and retained rights below.

Customer ownership does not include:

  • Dispensary Domination methods and processes
  • Research systems and procedures
  • Software, scripts, tools, and code libraries
  • Templates and frameworks
  • Checklists and training systems
  • Reusable layouts and structures
  • General knowledge and experience
  • Preexisting materials
  • Third party materials
  • Stock assets
  • Fonts, plugins, and licensed software
  • Unused drafts and rejected concepts
  • Generic icons and interface elements
  • Deidentified research and market information

Third party materials remain subject to their original licenses and terms.

Reusable Research and Materials

Dispensary Domination may reuse general research, deidentified findings, market data, keyword information, processes, structures, templates, frameworks, recommendations, icons, and other nonexclusive components when they may benefit another customer.

For example, research concerning searches in a specific city may remain useful when another dispensary later purchases research for the same market.

Before reusing customer related research, we will remove customer branding, private business information, account information, personal information, and keywords or details specific to the original dispensary.

The customer gives Dispensary Domination a perpetual, worldwide, royalty free license to retain, adapt, analyze, and reuse these deidentified and nonexclusive components.

Content and Images We Will Not Reuse

Dispensary Domination will not republish or provide another customer with page copy, blog posts, articles, or other original written content created specifically for the first customer.

We will not reuse custom photographs, illustrations, graphics, or other custom images created specifically for a customer, except for approved portfolio and case study use.

This restriction does not apply to stock assets, licensed elements, common icons, interface elements, templates, layout structures, or other reusable components that were not created exclusively for that customer.

Ownership Before Full Payment

Dispensary Domination retains ownership of unpaid work and deliverables until all related amounts are paid.

You may not publish, distribute, resell, transfer, copy, or use unpaid deliverables unless we give written permission.

Website and Store Materials

Dispensary Domination owns or licenses the website, product descriptions, training materials, guides, videos, graphics, branding, systems, templates, and other materials offered through the website.

You may not copy, scrape, reproduce, resell, republish, create competing products from, or commercially exploit these materials without written permission.

Purchasing a digital product gives the purchaser a limited, nonexclusive, nontransferable license to use it internally for the purchasing business. It does not permit resale, public distribution, sharing with unrelated businesses, or creation of competing training products.

Portfolio and Case Study Use

Unless you opt out, you permit Dispensary Domination to identify your business as a customer and use your business name, logo, public website, public deliverables, screenshots, and service results in our portfolio, case studies, proposals, presentations, social content, and marketing.

We will generally request permission before publishing a detailed case study, testimonial, or nonpublic performance information.

We will not intentionally publish passwords, private communications, customer lists, payment information, personal information, or confidential account information.

You may opt out by emailing support@dispensarydomination.com.

After receiving an opt out request, we will stop new portfolio use and remove materials under our direct control within a reasonable period. The request may not remove printed materials already produced, content already distributed, archived copies, or third party reposts outside our control.

Confidential Information

Each party may receive nonpublic business, technical, financial, marketing, or operational information from the other.

The receiving party will use reasonable care to protect confidential information and will use it only for the business relationship, purchased services, internal administration, or another authorized purpose.

Confidential information does not include information that:

  • Is publicly available without breach of an obligation
  • Was already lawfully known
  • Was received lawfully from another source
  • Was developed independently
  • Was deidentified and no longer identifies the customer or an individual

Information may be disclosed when required by law or legal process.

Feedback

If you provide ideas, suggestions, or feedback about our website, products, or services, you permit us to use that feedback without payment or restriction.

This does not give us ownership of your confidential business information or customer specific deliverables.

Acceptable Use

You may not use the website, products, services, accounts, forms, or downloads to:

  • Break any law or regulation
  • Commit fraud or impersonate another person
  • Interfere with website security or operation
  • Upload malware or harmful code
  • Gain unauthorized access to an account or system
  • Scrape, copy, or harvest website content or data
  • Resell or distribute digital products without permission
  • Violate intellectual property or privacy rights
  • Send spam or unlawful marketing
  • Submit false reviews, false claims, or misleading information
  • Use our work to support an unlicensed or unlawful business

Electronic Communications

You agree that orders, notices, approvals, invoices, disclosures, signatures, and other communications may be provided electronically.

You are responsible for maintaining a working email address and reviewing messages related to your account, order, subscription, or project.

Suspension and Termination

We may suspend or terminate access, work, or services if:

  • Payment is overdue or disputed
  • The customer breaches these terms
  • Required access or cooperation is not provided
  • The requested work creates a legal or safety risk
  • The customer abuses or threatens workers or partners
  • Continuing the relationship creates a conflict of interest
  • Fraud, misuse, or unauthorized activity is suspected

Termination does not remove payment duties for work performed, costs incurred, digital products delivered, or billing periods already started.

Third Party Links, Advertising, and Recommendations

The website may contain third party advertisements, sponsored content, affiliate links, partner recommendations, social content, and links to outside websites.

We may receive compensation from some relationships. Our Advertising and Affiliate Disclosure provides more information.

We are not responsible for an independent third party’s products, services, statements, availability, security, privacy, or conduct.

Privacy and Cookies

Our collection and use of personal information are described in our Privacy Policy.

Our use of cookies and similar technologies is described in our Cookie Policy.

Service Disclaimer

Products, services, reports, recommendations, and website materials are provided on an “as available” basis to the fullest extent permitted by law.

We do not promise that the website or every third party service will operate without interruption, delay, security issue, or technical error.

Except for obligations that cannot legally be excluded, we disclaim implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.

Limitation of Liability

To the fullest extent permitted by law, Dispensary Domination LLC and its owners, employees, contractors, subcontractors, and agents will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages.

This exclusion includes lost profits, lost sales, lost data, lost opportunities, reputational harm, business interruption, advertising loss, loss of search visibility, and costs of replacement services.

To the fullest extent permitted by law, our total liability arising from a one time purchase will not exceed the amount paid for the specific purchase giving rise to the claim.

Our total liability arising from a recurring service will not exceed the amount paid for that service during the six months immediately before the event giving rise to the claim.

These limits do not apply where liability cannot legally be limited.

Indemnification

You agree to defend and reimburse Dispensary Domination LLC and its owners, employees, contractors, and agents for third party claims, losses, penalties, and reasonable legal costs arising from:

  • Materials or instructions you provided
  • Your products, services, claims, promotions, or business practices
  • Your violation of law or license requirements
  • Your violation of another person’s intellectual property or privacy rights
  • Your misuse of our website, products, or deliverables
  • Your breach of these terms

This obligation does not apply to the extent a claim was caused by our own unlawful conduct, gross negligence, or intentional misconduct.

Events Outside Our Control

We are not responsible for delay or failure caused by events outside our reasonable control.

Such events may include internet or hosting failures, cyberattacks, natural disasters, labor disruptions, illness, government action, platform outages, changes in law, civil disorder, utility failure, supply shortages, and third party service interruptions.

International Use

You are responsible for determining whether the website, products, and services are lawful and appropriate in your location.

Accessing the website from another country does not change the governing law stated below.

Informal Dispute Resolution

Before filing a lawsuit, either party must send written notice describing the dispute and requested resolution.

Notices to Dispensary Domination must be sent to support@dispensarydomination.com with the subject “Legal Dispute Notice.”

The parties will make a good faith effort to resolve the dispute informally for at least 30 calendar days after the notice is received.

This requirement does not prevent either party from seeking urgent temporary relief when necessary to protect accounts, confidential information, intellectual property, or security.

California Law and Courts

These terms and any dispute arising from the website, products, services, or business relationship are governed by California law, without regard to conflict of law rules.

After completing the informal resolution process, claims must be brought in a state or federal court located in California that has jurisdiction over the dispute, unless applicable law requires another location.

Either party may bring an eligible claim in small claims court.

Changes to These Terms

We may update these terms when our website, products, services, business practices, or legal duties change.

The updated terms will be posted on this page with a revised date. Changes apply prospectively unless applicable law permits otherwise.

Material changes affecting a recurring service may receive additional notice where required.

Order of Terms

If these Terms and Conditions conflict with a signed agreement or accepted proposal, the signed agreement or accepted proposal controls for that specific conflict.

The remaining portions of these Terms and Conditions continue to apply.

Assignment

You may not transfer an order, subscription, account, or agreement without our written permission.

We may assign our rights and obligations as part of a merger, acquisition, restructuring, financing, asset transfer, or sale of the business.

Severability

If a court finds part of these terms unenforceable, that part will be limited or removed only to the extent necessary. The remaining terms will continue in effect.

No Waiver

A delay or failure to enforce a term does not waive the right to enforce it later.

Entire Agreement

These Terms and Conditions, the applicable order documents, and the policies incorporated by reference form the agreement concerning the website and purchased services.
